		<description><![CDATA[A recent poll by the AP/NORC Center for Public Affairs Research confirms what many of us who work with seniors already know:  less than one-third of Americans over age 40 have done any planning for the possibility of Long Term Care, and only about a quarter of those  who responded to the poll believe that it is "very likely" that they will need outside help when they reach their senior years.  Of course,  Federal Government figures show that the reverse is true, and that nearly 70% of Americans over age 65 will need some sort of long term care at some point in their lives.]]></description>

		<description><![CDATA[When a caregiver, including a family member, takes advantage of a senior's diminishing capacity for his own benefit, other loved ones may consider petitioning for Guardianship and/or Conservatorship.  If, due to a mental or physical health condition, the senior is truly unable to make reasonable decisions about her care, and there are no powers of attorney in place (or it is the agent, under the power of attorney, who is taking advantage of the senior), the appointment of a Guardian or Conservator may be the proper route.  However, it is certainly not the easy answer, for either the proposed Guardian/Conservator or the other family members.  First, the Petitioner must obtain a report from a physician; hen, she must go to Court and convince the judge to appoint the Guardian or Conservator.  The other family member will likely object, especially if he is acting under  a Power of Attorney, and the senior may object as well.  This would result in a trial that would be costly both in terms of money and heartache for the senior and other family members. However, Mediation maybe a better option.]]></description>

		<description><![CDATA[While the most controversial provisions of the Affordable Care Act will not go into effect until 2014, one provision that went into effect right away has resulted in significant savings for seniors.  USA Today has reported that seniors have saved at least $2.5 billion on prescription medications because of provisions that have narrowed, and will eventually close, the "doughnut hole." Seniors have saved an additional $2.5B as the result of the requirement that Medicare cover the full cost of certain preventative services, such as an annual physical, mammagrams and colorectal screenings.]]></description>
